    According to twitter, the McCanns haven't turned up at court today.

    IMO a clear sign that they know they will lose the case now, but also ensures they are not on Portuguese soil whilst SY are there questioning 'witnesses'!!

    This is good news in my book!
    Why on earth would the McCanns attend? This is purely a day for legal routine, nothing that needs their personal presence. Why would they bother travelling for that, especially with Amoral's proven record of pulling stupid, babyish stunts to delay proceedings?

    Oh, the PJ aren't interested in them either - Morais has told them that, Claudia and co have told them that. It's been announced on Portuguese TV by the PJ.

    Odd how it hasn't penetrated tiny, hater 'brains' yet.

    Rothely is, I believe, in the UK? The Yard is, I believe, in the UK? Do they ever stop and think about how STUPID they sound?

    All in all it went very well, in my opinion. Some excellent points were made by the defence lawyers after Dr Ricardo spoke for almost two hours.

    But first, a little detail that escaped me until today: Isabel Duarte is the lawyer for the McCann couple while Dr Ricardo is the lawyer for the children.

    What does this mean? It means that we were going to be subject to allegations by Isabel for 1.5 hours and allegations by Ricardo for another 1.5 hours.

    Isabel wasn't able to attend today's session, which means we only had to go through one half speeches. Still, Ricardo had to cut his allegations short by what I estimate was one-third as he ran out of time and the judge had to cut him short.

    We got a different court room today, not the usual one. This one was less freezing... And on the wall, just above the judge, this quote: "A injustiça feita a um é ameaça para todos". Injustice done to one [person] is a threat to everyone.

    The next session takes place on the 21st of January 2015.



    It will serve the purpose of the judge reading out what has been established as "matéria de facto" by the court. So potentially we may sense from what she will see as proved, or not, where the verdict may be going. But it will be only speculation... although I foresee an interesting discussion afterwards.

    Then we start counting 30 days that the McCanns have to produce the document from the High Court judge in London that will certify that they are allowed to represent Madeleine. We think that although they may have the document already, they will let this period run to the end to gain time. But of course they could produce the document before the 30 days run out.

    Then all lawyers have 10 days to hand in their "alegações de direito" which are written allegations about specific aspects of the law, as for example if the book's existence is illegal or not. And this potentially brings us to early March. So potentially we may have a verdict in March... or later.

    If they don't produce the document that enables them to represent Madeleine, only the part of the case that relates to her is thrown out. Everything else goes on.

    This is a one-sided version, favorable to the defendant.

    The ex-police officer who bungled the Madeleine McCann investigation made a fortune by spinning a web of lies about the case, a court heard today.
    Goncalo Amaral, 56, earned at least £344,000 from his book and TV documentary about Madeleine's disappearance, it was said.
    Amaral wrote 'distortions', 'fallacies', 'supposition' and 'a web of conspiracy theories' about the investigation, a libel trial in Lisbon was told.

    Ricardo Correia Afonso, representing Kate and Gerry McCann, told the court: 'What he published distorted the facts, and as a result the parents were judged and sentenced by public opinion.
    'His book is written like a novel and that's exactly what it is. The book and the DVD were produced to convince whoever saw or read them that the parents are guilty.'

    Mr Correia Afonso said the ex-detective made £270,000 from sales of his book in Portugal and £18,000 from sales abroad.
    He earned £26,000 from the broadcasting of the documentary, watched by 2.2m viewers in April 2009, and another £28,000 from sales of a DVD.
    The book is still on sale in some Portuguese bookshops despite being out of print, he said.
    And Mr Amaral has continued to publicly repeat the central claims in the book - that Madeleine died in the family's rented holiday apartment in the Algarve in May 2007 and that her parents covered up her death.
    The former head of the Madeleine investigation gave an interview in June this year in which he 'had no problem stating that the parents of the child are the only guilty parties', the lawyer said.
    Mr Amaral even told a Portuguese newspaper a theory that Madeleine had been buried in a coffin alongside a dead women in a church in the resort of Praia da Luz, the court was told.
    Mr Amaral's discredited theories on Madeleine's disappearance have been widely repeated in newspapers in Portugal and around the world including Brazil and Spain, he said.
    The McCanns are suing Mr Amaral for £1m over his book The Truth Of The Lie and the accompanying documentary.

    He was thrown off the investigation in 2007 after criticising British police officers involved in the search for Madeleine.
    In July the McCanns, both 46-year-old doctors from Rothley, Leicsestershire, told the court at the Palace of Justice in Lisbon that they had been 'devastated and crushed' by the book about their daughter, who was days short of her fourth birthday when she disappeared.
    But Miguel Cruz Rodrigues, for Mr Amaral, said the McCanns were suing 'to rid themselves of guilt for their negligent conduct and their conduct in relation to the investigation.
    He added: 'There was a lack of cooperation with the police authorities.
    'That lack of cooperation led to the archiving of the investigation.'
    Responding to claims the book had caused the McCanns insomnia, lack of appetite and depression, he said: 'The crux of this case is these were not caused by Goncalo Amaral's book, but rather they were caused by the fact the McCanns will feel guilty all their lives for not looking after their children.'
    Fatima de Oliveira Esteves, representing publisher Guerra e Paz, admitted that Mr Amaral 'appeared to have invented' much of the book.
    But she added: 'The fact is those children were left alone and because of that fact one of them disappeared.
    'Anxiety and depression were caused by the disappearance of the child, not because of the book.'
    And Miguel Coroadinha, representing TVI, which broadcast the documentary, said the McCanns 'want us to hear only a single version of the facts, which is their version'.
    He added: 'Freedom of expression and thought is one of our fundamental rights.'
    Judge Maria de Melo e Castro said the court will convene on January 21 to discuss which facts have been proved. She is expected to defer judgment until February.
     Well said that man - it's about time people stopped mincing their words about Amoral.

    And despite her nasty remarks, Ms Esteves hasn't exactly helped G & P - or Gonzo.

    She's just admitted Madeleine was abducted.

She went to all that trouble for you ungrateful bunch to assist at the hearings and to write up transcripts and all you could do was to question her honesty. You prefer to believe a misunderstanding by a British journalist. You are certainly clutching at straws. If it makes you happy I won't say anymore. I have my information from someone who heard all of the allegations in the court room and is trilingual.

    He also recalled that Stuart Prior was "very worried" when he met with the PJ on the fourth of september, just days before the McCanns were made arguidos. And that he was worried because he knew it was wrong to accuse them of anything because there was no evidence and the DNA reports were being misread, for the PJ's convenience.

    Whats all this about,i know the mccanns and call me stu were very friendly,but Martin Grime and Mark Harrison had concerns too?

    From Myths with thanks to the poster.
     With the Portuguese (farcical) law of judicial secrecy it is evident in the Madeleine McCann case that they didn't uphold their own laws and leaked information and misinformation like a sieve. I would suggest that they single handed have aided and abetted the abductor/s in perpetrating the crime against Madeleine.

    They did not act on reports of a 'predator/s' in the area.
    They disregarded some witness statements.
    They held the McCann's to ransom regarding the judicial secrecy, but they leaked misinformation and information to the press/other sources.
    Their tunnel vision in trying to 'pin it on the parents' did not allow them, in the early stages of the investigation, to investigate any other theory.
    The continued Portuguese bureaucracy (red tape) regarding Scotland Yards involvement appears, to the general public, as a tactic of delay.
    There are more examples, above are only a few that support my claim.
    The next question then is.......WHY?
    I'd like an independent UK lead investigation into how the pj have managed the case. Early red flag - Amaral was involved in two missing children cases where he tried to pin it on the family/parents. At the time leading policeman had/s a criminal record (Arguido). Disregard for the laws they uphold (or suppose to uphold). Utter mess they made of the initial investigation. And (big red flag) the propaganda campaign run by Amaral to ensure the continued spread of lies and misinformation, que: Levy, Joana Morais, Blacksmith, Astro and other forkers.

    Ricardo Afonso (lawyer for the McCann children) spent almost two hours talking about numbers, comparing the book with selected bits of the case files and trying to discredit Gonçalo Amaral, the PJ and the dogs, while insisting that the British police didn't agree with the PJ's conclusions that led to the McCanns being made arguidos.

    One example of his reasoning: the book starts with a mention of hunters hunting rabbits, which allegedly is out of season. So if the reference to the rabbit hunting season is wrong, everything else in the book is wrong, too.

    It just went on and on and downwards fast.

    He tried to dispute the dogs, the DNA tests, Mark Harrison's report which he said was only focused on the death possibility. The PJ, he alleged, was hell bent on accusing the McCanns and made the evidence fit the accusations.

    In short, he was discussing stuff that was never subject to discussion; large parts of his allegations were focused on discussing the investigation and the McCanns' arguido status, with several references to Alipio Ribeiro and his "precipitation" quote.

    He also attacked the Smiths' credibility and questioned why they were seen as credible by the investigation while Jane Tanner was discredited. He said that Tanner's sighting corroborated the Smiths' sighting, but the coordinator, Amaral, and his team simply wouldn't investigate anything except the death thesis and the McCanns.

    The defendant, he said, just wanted to "sell blood, sweat and tears".

    He added that the investigation deviated from any objectivity and that the British police, Martin Grime and Mark Harrison realised this and feared that the McCanns were going to be subject to an impulsive, unfounded making of arguidos.

    He also recalled that Stuart Prior was "very worried" when he met with the PJ on the fourth of september, just days before the McCanns were made arguidos.     This is roughly where he was interrupted by the judge. He didn't spend two minutes addressing his own witnesses' testimonies.

    Talking of libel, does anyone else think that amaral has admitted he wrote fiction and now its just come down to whether his fiction caused damage. I think UK libel law is going to be changed to mean libel must have caused damage to the victim.

    There has been a lot of talk about what caused the damage to the McCanns, whether they can represent Madeleine and it appeared amaral thought Madeleine would be declared dead in 2014. Yet little talk about the truth of his allegations. If he had written his book directly from the files the case would have been open and shut, nothing to worry about for him. Yet his publisher admits he made it up and he has done everything to drag the trial out (perhaps under the assumption that Madeleine would be declared dead by the time it came to trial). So I don't think the fact he made it up is in question, its now down to whether the McCann's can represent Madeleine and if he caused them damage.
